1. Agreement to Terms

By accessing or using Tahiti Buy & Sell ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. The Platform is operated by Tahiti Buy & Sell LLC, a Utah limited liability company.

2. Description of Service

Tahiti Buy & Sell is a hyperlocal online marketplace for the people of French Polynesia. Users may post listings to buy and sell physical goods and services locally, communicate with other users, and leave reviews.

3. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent that you are at least 18 years old.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary.

5. Marketplace Disclaimer

Tahiti Buy & Sell is a platform that connects independent buyers and sellers. We do not own, sell, inspect, or guarantee any listings posted by users. We are not a party to any transaction between buyers and sellers and are not responsible for the quality, safety, legality, or accuracy of any listing, the ability of sellers to complete a sale, or the ability of buyers to complete a purchase. All transactions are solely between buyers and sellers. Users engage in transactions at their own risk.

6. Prohibited Activities

You agree not to:

• Post false, misleading, or fraudulent listings
• Harass, threaten, or harm other users
• Post illegal items or services
• Create multiple accounts to evade bans or restrictions
• Use the Platform for any unlawful purpose
• Scrape, copy, or reproduce Platform content without permission
• Attempt to gain unauthorized access to any part of the Platform

7. User Content

You retain ownership of content you post on the Platform. By posting content, you grant Tahiti Buy & Sell LLC a non-exclusive, royalty-free license to display and distribute your content in connection with operating the Platform. You are solely responsible for the content you post.

8. Reviews

Users may leave reviews for sellers. Reviews must be honest and based on genuine transactions. We reserve the right to remove reviews that violate these Terms or that are fraudulent, abusive, or inappropriate.

9. Intellectual Property

The Platform and its original content, features, and functionality are owned by Tahiti Buy & Sell LLC and are protected by applicable intellectual property laws.

10. Copyright Infringement

If you believe content on the Platform infringes your copyright, please contact us at jacob@tahitibuysell.com with a description of the alleged infringement and the content in question. We will review and respond to valid claims promptly.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any conduct we deem harmful to the Platform or its users.

12. Limitation of Liability

To the maximum extent permitted by law, Tahiti Buy & Sell LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you have paid us in the past twelve months, if any.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall first be subject to informal negotiation for a period of 30 days. If unresolved, disputes shall be submitted to binding arbitration in the state of Utah, United States. If arbitration is not applicable, disputes shall be litigated in the courts of Utah.

14. Governing Law

These Terms shall be governed by the laws of the State of Utah, United States, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes by email at jacob@tahitibuysell.com. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
